Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Ref LeakLog service operated by Elite Tech Global LLC, a Utah limited liability company. This AUP is incorporated into and supplements our Terms of Service. Capitalized terms not defined herein have the meanings given in the Terms of Service.

By using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account.

1. Lawful Use

You must use the Service only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations, including but not limited to:

  • The Clean Air Act (42 U.S.C. § 7401 et seq.)
  • The AIM Act (42 U.S.C. § 7675)
  • EPA regulations at 40 CFR Part 82, Subpart F
  • All applicable state and local environmental and licensing regulations
  • Data protection and privacy laws

2. Data Integrity

2.1 Accurate Data Entry

Given the regulatory compliance purpose of the Service, data integrity is critical. You agree to:

  • Enter accurate, truthful, and complete information for all equipment records, service events, refrigerant quantities, and other compliance data
  • Record service events in a timely manner, consistent with EPA recordkeeping requirements
  • Correct errors in your data promptly upon discovery
  • Ensure that all users within your organization understand and follow these data integrity requirements

2.2 Prohibited Data Practices

You must not:

  • Fabricate records: Enter false service events, equipment records, or refrigerant data that do not correspond to actual work performed
  • Falsify compliance data: Manipulate data entries to make leak rates appear lower than actual, avoid triggering repair requirements, or create the appearance of compliance where none exists
  • Create fraudulent reports: Generate or modify PDF reports with the intent to present false compliance information to regulatory agencies, customers, or other parties
  • Backdate records: Enter records with intentionally false dates to create a misleading compliance timeline
  • Misrepresent certifications: Enter false or expired EPA Section 608 certification information for yourself or any technician in your organization

Warning: Falsifying EPA compliance records may constitute a violation of federal law, including the Clean Air Act, and may result in criminal penalties. Elite Tech Global LLC may be required to cooperate with law enforcement investigations involving falsified records created through the Service.

3. Account and Access Rules

3.1 Credential Security

You must:

  • Keep your account credentials confidential and not share them with anyone
  • Use a unique, strong password for your Ref LeakLog account
  • Notify us immediately at support@refleaklog.app if you suspect unauthorized access to your account

3.2 Seat Limits and Account Sharing

You must not:

  • Share a single user account among multiple people — each individual who accesses the Service must have their own user account
  • Create multiple organizations to circumvent seat limits instead of upgrading your subscription plan
  • Rapidly activate and deactivate technician accounts to rotate access beyond your plan's seat limit
  • Use automation, bots, or scripts to create accounts or circumvent access controls

3.3 Organization Management

Organization Owners are responsible for:

  • Ensuring all invited technicians are authorized personnel with valid EPA certifications (as applicable)
  • Promptly deactivating accounts for individuals who are no longer authorized to access the Service (e.g., terminated employees)
  • Monitoring the activity within their organization for compliance with this AUP

4. Technical Restrictions

You must not:

  • Attempt to gain unauthorized access to the Service, other user accounts, other organizations' data, or any systems or networks connected to the Service
  • Use the Service to transmit viruses, malware, worms, trojan horses, or any other malicious or destructive code
  • Interfere with or disrupt the integrity, performance, or availability of the Service or its underlying infrastructure
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
  • Scrape, crawl, spider, or use automated tools to extract data from the Service beyond normal use of its features
  • Probe, scan, or test the vulnerability of the Service or any connected system without our express written permission
  • Circumvent or attempt to circumvent any security measures, authentication mechanisms, rate limits, or access controls
  • Use the Service in a manner that imposes a disproportionately large load on our infrastructure

5. Prohibited Uses

In addition to the restrictions above, you must not use the Service to:

  • Develop, train, or improve a competing product or service
  • Resell, redistribute, or provide access to the Service to third parties as a standalone offering
  • Store or transmit content that is illegal, threatening, abusive, harassing, defamatory, or obscene
  • Impersonate another person or entity
  • Engage in any activity that could damage, disable, or impair the Service

6. Enforcement

6.1 Investigation

We reserve the right to investigate suspected violations of this AUP. During an investigation, we may review relevant account data and activity logs.

6.2 Consequences

If we determine, in our sole discretion, that you have violated this AUP, we may take any or all of the following actions:

  • Issue a written warning
  • Temporarily suspend your access to the Service
  • Permanently terminate your account without refund
  • Remove or disable access to content that violates this AUP
  • Report suspected illegal activity to appropriate law enforcement or regulatory authorities

6.3 Cooperation with Authorities

We may cooperate with law enforcement agencies, regulatory bodies (including the EPA), and court orders that require us to disclose information about users who are suspected of violating applicable laws. This cooperation may include providing account information, access logs, and data records in response to valid legal process.

7. Reporting Violations

If you become aware of any violation of this AUP, please report it immediately to support@refleaklog.app. We take all reports seriously and will investigate accordingly.

8. Changes to This Policy

We may update this AUP from time to time. Changes will be posted on this page with a revised "Last Updated" date. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes become effective constitutes your acceptance of the revised policy.
